1. Acceptance of terms

Welcome to BottleChallenge! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BrainGreen Foundation ("we," "us," or "our"), operating as BottleChallenge.

By accessing or using our mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users, including visitors, registered users, partners, and any other persons who access or use the Service.

Important: By using BottleChallenge, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of service

BottleChallenge is an environmental initiative that helps users find free water refill points around the world. Our Service includes:

Map and discovery: an interactive map showing water refill stations, cafés, restaurants, and other locations offering free water refills
User accounts: personal accounts to save favorites, track visits, and earn rewards
EcoDrops rewards: a points-based system rewarding users for sustainable behavior
Partner program: tools for businesses to join our network and offer refills to users
NFC/QR scanning: NFC tags and QR codes at participating locations that users can scan to verify refill visits and earn EcoDrops
EcoDrops shop: a reward store where users can spend earned EcoDrops on experiences, vouchers, and other rewards from our reward partners
Donations: the ability to support the project through monetary donations processed via WhyDonate
Community features: ratings, reviews, and photos shared by users

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Eligibility

To use the Service, you must:

Be at least 16 years old (or the age of digital consent in your jurisdiction)
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the Service under applicable laws
Provide accurate and complete information during registration

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Minors: If you are between 16 and 18 years old, you confirm that you have obtained parental or guardian consent to use the Service.

4. Account registration

4.1 Creating an account

Some features require you to create an account. When registering, you agree to:

Provide accurate, current, and complete information
Keep your account information updated
Maintain the security of your password
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

4.2 Account security

You are solely responsible for maintaining the confidentiality of your login credentials. We are not liable for any loss or damage arising from your failure to protect your account.

4.3 One account per user

Each user may maintain only one personal account. Creating multiple accounts to abuse the rewards system or circumvent restrictions is prohibited.

5. User conduct

When using the Service, you agree NOT to:

Prohibited activities

Violate any applicable laws, regulations, or third-party rights
Post false, misleading, or inaccurate information about refill locations
Harass, abuse, threaten, or intimidate other users
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to the Service or other accounts
Use bots, scrapers, or automated tools without permission
Manipulate ratings, reviews, or the rewards system
Impersonate any person or entity
Spam or send unsolicited communications
Use the Service for commercial purposes without authorization
Interfere with or disrupt the Service or servers
Circumvent any security measures or access controls

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending accounts, and reporting to law enforcement.

6. User content

6.1 Your content

You may submit content to the Service, including reviews, ratings, photos, comments, and location information ("User Content"). You retain ownership of your User Content, but grant us certain rights as described below.

6.2 License grant

By submitting User Content, you grant BottleChallenge a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Service.

6.3 Content standards

Your User Content must not:

Be false, misleading, or deceptive
Infringe intellectual property rights of others
Contain defamatory, obscene, or offensive material
Include personal information of others without consent
Promote illegal activities or harmful behavior

6.4 Content moderation

We may, but are not obligated to, review, monitor, or remove User Content at our discretion. We are not responsible for User Content posted by third parties.

7. Intellectual property

7.1 Our intellectual property

The Service, including its design, features, content, trademarks, logos, and software, is owned by BrainGreen Foundation and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

7.2 Trademarks

"BottleChallenge," "EcoDrops," and related logos are trademarks of BrainGreen Foundation. You may not use these marks without our prior written consent.

7.3 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us the right to use such feedback without any obligation to you.

8. EcoDrops rewards program

8.1 Earning EcoDrops

Users can earn EcoDrops points through various activities, including:

Recording refill visits at participating locations
Adding new refill stations to the map
Writing reviews and uploading photos
Referring new users
Participating in special challenges and events

8.2 Redeeming EcoDrops

EcoDrops can be redeemed for rewards in our shop, including discounts, merchandise, and donations to environmental causes. Redemption options may vary and are subject to availability.

8.3 Program rules

EcoDrops have no cash value and cannot be sold or transferred
Points may expire after 12 months of account inactivity
We reserve the right to modify point values, rewards, and program rules
Fraudulent activity will result in forfeiture of points and account termination
We may cap the number of points earned per day or activity

9. Partner locations

9.1 Third-party locations

The Service displays information about water refill locations operated by third parties. We do not own, operate, or control these locations and are not responsible for:

The availability or quality of water at any location
The accuracy of information provided by partners
The conduct of staff at partner locations
Any interactions between users and partners

9.2 No endorsement

Listing a location on BottleChallenge does not constitute an endorsement or recommendation. Users should exercise their own judgment when visiting locations.

9.3 Partner obligations

Partners who join our network agree to separate Partner Terms of Service governing their participation and obligations.

10. NFC/QR tag scanning

10.1 How it works

BottleChallenge uses NFC (Near Field Communication) tags and QR (Quick Response) codes placed at participating refill locations. When you scan a tag, we verify your presence at the location and award EcoDrops to your account.

10.2 Data collected

When you scan a tag, we collect:

The tag's unique identifier (UID)
Timestamp of the scan
Your approximate GPS location (if location permissions are granted)
Your device type and NFC/camera capability

This data is used to verify your visit, prevent fraud, and award the correct number of EcoDrops. For full details, see our Privacy Policy.

10.3 Usage rules

You must be physically present at the location to scan a tag
Cooldown periods may apply between consecutive scans at the same location
GPS spoofing, tag cloning, or automated scanning is strictly prohibited
Tampering with, moving, or damaging physical tags is prohibited

10.4 NFC compatibility

NFC scanning requires a compatible device and browser (currently Chrome on Android). QR code scanning is available on all devices with a camera. We make no guarantee that NFC scanning will work on all devices.

11. Donations

11.1 Donation processing

Donations to BottleChallenge (BrainGreen Foundation) are processed through WhyDonate, a third-party payment processor. By making a donation, you also agree to WhyDonate's terms and privacy policy.

11.2 Use of funds

All donations are used to support BottleChallenge's mission, including platform development, server infrastructure, NFC/QR tag production, marketing, and operational costs.

11.3 Refunds

Donations are voluntary and generally non-refundable. In exceptional circumstances (e.g., duplicate charges, incorrect amounts), contact us within 14 days at [email protected].

11.4 Tax information

BrainGreen Foundation is a registered Polish foundation (KRS: 0000964547). Donations may be tax-deductible depending on your jurisdiction. We can provide donation confirmations upon request.

12. EcoDrops shop

12.1 Overview

The EcoDrops shop allows users to redeem earned EcoDrops for rewards provided by our reward partners, including vouchers, experiences, and other items.

12.2 Purchasing rewards

Rewards are purchased exclusively with EcoDrops — no real currency is involved
Availability of rewards is subject to stock and partner participation
Once redeemed, a unique voucher code is generated for the reward
Voucher codes are personal, non-transferable, and may have expiration dates

12.3 Reward partner responsibilities

Rewards are provided by third-party reward partners. BottleChallenge is not responsible for the quality, availability, or fulfillment of rewards. Disputes regarding redeemed rewards should first be directed to the reward partner.

12.4 Refunds

EcoDrops spent on rewards are generally non-refundable. If a reward partner fails to honor a valid voucher, contact us and we will work to resolve the issue, which may include restoring your EcoDrops.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE"

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
WARRANTIES OF NON-INFRINGEMENT
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF ANY INFORMATION

We do not warrant that:

Refill locations will be open, available, or offer free water
Water quality at any location meets any particular standard
Information provided by users or partners is accurate or current
The Service will meet your specific requirements

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRAINGREEN FOUNDATION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF PROFITS, DATA, OR GOODWILL
SERVICE INTERRUPTION OR COMPUTER DAMAGE
COST OF SUBSTITUTE SERVICES
ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

Maximum liability: In no event shall our total liability exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) €100.

15. Indemnification

You agree to indemnify, defend, and hold harmless BrainGreen Foundation, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any third-party rights
Any dispute between you and another user or partner

16. Termination

16.1 Termination by you

You may stop using the Service at any time. To delete your account, contact us at [email protected] or use the account deletion feature in settings.

16.2 Termination by us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include:

Violation of these Terms
Fraudulent or illegal activity
Extended period of inactivity
Request by law enforcement
Discontinuation of the Service

16.3 Effect of termination

Upon termination, your right to use the Service ceases immediately. We may delete your account data, including accumulated EcoDrops. Provisions that by their nature should survive termination will remain in effect.

17. Dispute resolution

17.1 Informal resolution

Before filing any formal dispute, you agree to first contact us at [email protected] to attempt to resolve the matter informally. We will try to resolve disputes within 30 days.

17.2 Governing law

These Terms are governed by the laws of Poland, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

17.3 Jurisdiction

For EU residents, disputes may be resolved in the courts of your country of residence. For other users, you agree to the exclusive jurisdiction of the courts in Warsaw, Poland.

17.4 EU dispute resolution

If you are an EU consumer, you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

17.5 Class action waiver

To the extent permitted by law, you agree to resolve disputes individually and waive any right to participate in class actions or collective proceedings.

18. Changes to terms

We may modify these Terms at any time. When we make material changes, we will:

Post the revised Terms with an updated "Last Updated" date
Notify you via email or in-app notification (for significant changes)
Provide at least 30 days' notice before changes take effect (where required by law)

Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

19. General provisions

19.1 Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy, and any other agreements referenced herein, constitute the entire agreement between you and BottleChallenge.

19.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any affiliate or successor.

19.5 Force majeure

We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, or government actions.

19.6 No third-party beneficiaries

These Terms do not create any rights for third parties, except as expressly stated.

19.7 Language

These Terms are written in English. If translated into other languages, the English version shall prevail in case of any discrepancy.
