Please read these terms carefully

1. Acceptance of terms
Welcome to BottleChallenge! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and BrainGreen Foundation ("we," "us," or "our"), operating as BottleChallenge.
By accessing or using our mobile application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
These Terms apply to all users, including visitors, registered users, partners, and any other persons who access or use the Service.
Important: By using BottleChallenge, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of service
BottleChallenge helps people find places where they can refill a reusable water bottle, in many countries. The Service includes:
- Map and discovery: an interactive map showing water refill stations, cafés, restaurants, and other locations offering free water refills
- User accounts: personal accounts to save favorites, track visits, and earn rewards
- EcoDrops: internal loyalty units you receive for refills you record by tapping an NFC tag
- Partner tools: dashboards for venues offering refills, for organisations offering rewards, and for public bodies
- NFC tags: tags at participating points that you tap to confirm a refill visit and receive EcoDrops
- EcoDrops shop: a reward store where users can spend earned EcoDrops on experiences, vouchers, and other rewards from our reward partners
- Donations: the ability to support the project with money, processed by Stripe
- Contributions: photographs of refill points, new points added by users, and suggested corrections to points already listed
We may change, suspend or discontinue part of the Service. Where a change would materially reduce what the Service offers you, we will give you reasonable notice unless a legal duty, a security problem or a supplier failure makes that impossible. This reflects Article 19 of Directive (EU) 2019/770 on digital content and digital services.
3. Eligibility
To use the Service, you must:
- be at least 16 years old;
- have the legal capacity to enter into a binding agreement, or the consent of your parent or guardian if you are under 18;
- not be barred from using the Service under any law that applies to you;
- give accurate and complete information when you register.
We set a single minimum age of 16 worldwide. Some countries allow a lower age for consent to online services, and some require a higher one for a binding contract. We use 16 everywhere because it is simpler and safer than a rule that changes by country.
If you are using the Service on behalf of an organisation, you confirm that you may bind that organisation to these Terms.
We do not ask your age when you register. We rely on your confirmation here rather than on an age check. If we learn that an account belongs to someone under 16, we will close it and delete the personal data. A parent or guardian who believes their child holds an account should write to [email protected] and we will act without undue delay.
4. Account registration
4.1 Creating an account
Some features require you to create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Keep your account information updated
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4.2 Account security
You are solely responsible for maintaining the confidentiality of your login credentials. We are not liable for any loss or damage arising from your failure to protect your account.
4.3 One account per user
Each user may maintain only one personal account. Creating multiple accounts to abuse the rewards system or circumvent restrictions is prohibited.
5. User conduct
When using the Service, you agree NOT to:
Prohibited activities
- Violate any applicable laws, regulations, or third-party rights
- Post false, misleading, or inaccurate information about refill locations
- Harass, abuse, threaten, or intimidate other users
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to the Service or other accounts
- Use bots, scrapers, or automated tools without permission
- Manipulate the EcoDrops system, including by recording refills you did not make
- Impersonate any person or entity
- Spam or send unsolicited communications
- Use the Service for commercial purposes without authorization
- Interfere with or disrupt the Service or servers
- Circumvent any security measures or access controls
We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending accounts, and reporting to law enforcement.
6. User content
6.1 Your content
You may contribute content to the Service. At present that means photographs of refill points, the details of a point you add, and suggested corrections to a point already listed ("User Content"). You keep ownership of your User Content and grant us the licence described below.
6.2 License grant
By contributing User Content you grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, resize, translate, publish, distribute and display it for the purpose of operating and promoting the Service. We may sublicense this to the providers who host and deliver the Service on our behalf.
The licence lasts while the content is published. If you delete the content or your account, we stop using it, except for copies already included in printed or archived material and for backups until they are overwritten in the ordinary course. We will not sell your content or license it to third parties for their own advertising.
6.3 Content standards
Your User Content must not:
- Be false, misleading, or deceptive
- Infringe intellectual property rights of others
- Contain defamatory, obscene, or offensive material
- Include personal information of others without consent
- Promote illegal activities or harmful behavior
6.4 Content moderation
We review contributions before they change a public listing, and we may remove content that breaks these Terms, our Acceptable Use Policy or the law. We do not generally monitor everything that is contributed, and we are not responsible for content contributed by others.
If we remove your content or restrict your account, we will tell you why and you can appeal. Article 17 of Regulation (EU) 2022/2065, the Digital Services Act, requires that statement of reasons and it binds us. The six month appeal window we offer comes from Article 20 of the same Regulation, from which Article 19 exempts an enterprise of our size; we give it anyway. How to appeal is set out in section 10 of the Acceptable Use Policy.
You can report content you believe is illegal or breaks our rules to [email protected]. That address is also our single point of contact for users, for authorities and for the European Commission under Articles 11 and 12 of that Regulation. We accept communications at it in English and Polish.
So that we can act on a report, please include the four things Article 16(2) asks for: why you believe the content is unlawful or breaks our rules, exactly where it is, a way to reach you, and a statement that you believe your report is accurate. Section 9 of the Acceptable Use Policy explains what happens next.
If we become aware of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of a person has taken place, is taking place or is likely to take place, we will inform the law enforcement or judicial authorities concerned, as Article 18 of that Regulation requires.
7. Intellectual property
7.1 Our intellectual property
The Service, including its design, features, content, trademarks, logos, and software, is owned by BrainGreen Foundation and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
7.2 Trademarks
"BottleChallenge," "EcoDrops," and related logos are trademarks of BrainGreen Foundation. You may not use these marks without our prior written consent.
7.3 Feedback
If you send us a suggestion or an idea about the Service, we may use it to improve the Service without owing you anything for it. You keep any rights you have in what you sent, and we are not asking you to transfer them.
8. EcoDrops rewards program
8.1 Earning EcoDrops
EcoDrops can be received in the ways listed in the EcoDrops Rewards Terms, which is the complete list. At the date of these Terms it is:
- recording a refill by tapping an NFC tag at a participating point;
- a one-off welcome bonus, paid when you complete your first refill;
- adding a new refill point that our moderators then approve;
- inviting someone who joins and then completes their first refill.
The current amounts, the daily limits and the expiry rules are set out in the EcoDrops Rewards Terms. There is no reward for writing a review, and no review feature exists.
8.2 Redeeming EcoDrops
EcoDrops can be redeemed for rewards in our shop, such as tickets for cinemas, theatres, museums, concerts and events, and discounts offered by reward partners. Redemption options may vary and are subject to availability.
8.3 Program rules
- EcoDrops have no cash value and cannot be sold or transferred
- EcoDrops expire in batches, 6 months after they were earned; spending always uses the batch closest to expiring first (see the EcoDrops Rewards Terms)
- We reserve the right to modify point values, rewards, and program rules
- Fraudulent activity will result in forfeiture of points and account termination
- We may cap the number of points earned per day or activity

9. Partner locations
9.1 Third-party locations
The Service displays information about water refill locations operated by third parties. We do not own, operate, or control these locations and are not responsible for:
- The availability or quality of water at any location
- The accuracy of information provided by partners
- The conduct of staff at partner locations
- Any interactions between users and partners
9.2 No endorsement
Listing a location on BottleChallenge does not constitute an endorsement or recommendation. Users should exercise their own judgment when visiting locations.
9.3 Partner obligations
Partners accept separate terms governing their participation, depending on what they do:
- venues offering refills accept the Refill Partner Terms;
- organisations offering rewards accept the Reward Partner Terms;
- municipalities and other public bodies accept the Municipality Terms.
Those terms bind the partner, not you.
11. Donations
11.1 Donation processing
Donations to BrainGreen Foundation are processed by Stripe. You are taken to a payment page hosted by Stripe and returned to our site afterwards. The Foundation is the recipient of the donation and holds the Stripe account. Your card details never reach our systems.
11.2 Use of funds
Donations are used to run and develop the project, including servers and hosting, NFC tag production, software development, communication and operating costs.
11.3 Refunds
Donations are voluntary and are not refundable, except in the cases listed in the Donation Terms. In those cases (e.g., duplicate charges, incorrect amounts), contact us within 30 days at [email protected].
11.4 Tax information
BrainGreen Foundation is a registered Polish foundation (KRS: 0000964547). Donations may be tax-deductible depending on your jurisdiction. We can provide donation confirmations upon request.

12. EcoDrops shop
12.1 Overview
The EcoDrops shop allows users to redeem earned EcoDrops for rewards provided by our reward partners, including vouchers, experiences, and other items.
12.2 Purchasing rewards
- Rewards are purchased exclusively with EcoDrops, no real currency is involved
- Availability of rewards is subject to stock and partner participation
- Once redeemed, a unique voucher code is generated for the reward
- Voucher codes are personal, non-transferable, and may have expiration dates
12.3 Reward partner responsibilities
Rewards are provided by third-party reward partners. BottleChallenge is not responsible for the quality, availability, or fulfillment of rewards. Disputes regarding redeemed rewards should first be directed to the reward partner.
12.4 Refunds
Spending EcoDrops is final, but you are protected if the reward is not delivered. Report a problem through the Platform within 90 days of obtaining the reward. The reward partner has five calendar days to respond, and if they do not, your EcoDrops are returned and the voucher is cancelled automatically. The EcoDrops Rewards Terms set out the procedure in full.
13. Disclaimers
Your legal rights come first. Nothing in this section or the next one takes away rights you have under the law of your own country that cannot be excluded by agreement. If you are a consumer in the European Union, Directive (EU) 2019/770 applies to this Service even though you pay nothing for it, because you provide personal data. That means the Service must match its description, be fit for its ordinary purpose, and receive the updates needed to keep it in conformity. Where anything below conflicts with a right of that kind, the right prevails and the rest of the section still stands.
Beyond those rights, we provide the Service as it is and as available, and we do not promise that it will be uninterrupted or error free. We do not disclaim security: our security obligations are described in our Privacy Policy and Article 32 of the GDPR applies to us regardless of anything said here.
In particular, we do not warrant that:
- Refill locations will be open, available, or offer free water
- Water quality at any location meets any particular standard
- Information provided by users or partners is accurate or current
- The Service will meet your specific requirements
14. Limitation of liability
What we never exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for damage caused intentionally, which under Article 473 section 2 of the Polish Civil Code cannot be excluded in advance, for damage caused by gross negligence, which we do not seek to exclude, for fraud, for a breach of your rights under data protection law, for physical damage to your property, for claims under Article 82 of the GDPR, or for anything else that the law does not allow us to limit.
Subject to the paragraph above, we are not liable for indirect or consequential loss, for lost profits, lost business or lost goodwill, or for loss arising because a refill point turned out to be closed, inaccessible or not as described.
We are liable for loss caused by our failure to provide the Service with reasonable care, to the extent the law makes us liable. Where Polish law applies, that means the normal consequences of the failure under Article 361 section 1 of the Polish Civil Code. We do not try to narrow that test by agreement.
Maximum liability. Subject to the box above, our total liability to you for purely financial loss arising in any twelve month period is limited to EUR 500. The cap applies only to purely financial loss. It does not apply to personal injury, to physical damage to property, to claims under Article 82 of the GDPR, or to your conformity rights under Directive (EU) 2019/770, all of which sit outside it. The cap is a fixed sum rather than a multiple of what you paid, because the Service is free.
If you use the Service under the Refill Partner Terms, the Reward Partner Terms or the Municipality Terms, the liability provisions of those terms apply to that activity instead of this section. If you are a natural person and your use is only partly for business, and business is not your predominant purpose, you remain a consumer and this section applies to you in full.
15. Indemnification
This section does not apply to you if you are a consumer. A person using the Service for private purposes owes us nothing under it. It applies only where you use the Service in the course of a trade, business or profession.
If you use the Service in the course of a trade, business or profession, you will cover our reasonable losses and legal costs, up to EUR 25,000 in any twelve month period, to the extent they result from your own culpable breach of these Terms and arise from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
- Any dispute between you and another user or partner
16. Termination
16.1 Termination by you
You may stop using the Service at any time. To delete your account, contact us at [email protected] or use the account deletion feature in settings.
16.2 Termination by us
We may suspend or end your access for one of the following reasons, and not otherwise:
- you break these Terms or the Acceptable Use Policy;
- fraudulent or unlawful activity, including recording refills you did not make;
- we are required to act by law, by a court or by a competent authority;
- we discontinue the Service.
We will tell you the reason, and you can appeal for at least six months, as described in section 10 of the Acceptable Use Policy. Except where we must act immediately, we will give you notice first and a chance to put things right. If we discontinue the Service we will give at least 30 days' notice.
We will not close your account merely because you have not used it for a while. If we ever need to change that, we will tell you first and give you a chance to keep the account.
16.3 Effect of termination
When your account ends, your right to use the Service stops. EcoDrops have no cash value, so nothing is owed for them, but they are not simply taken away either.
- If you close your account, unspent EcoDrops are lost at that point. You can spend them first.
- If we discontinue the Service, you will have at least 90 days from our notice to spend your balance, as promised in the EcoDrops Rewards Terms.
- If we close your account for a reason other than fraud, we will tell you first and give you a reasonable chance to spend your balance.
- Only where an account is closed for fraud is the balance forfeited immediately.
Before we close an account for a reason other than fraud, we will give you a reasonable opportunity to request a copy of your data. You can ask for that copy at any time under our Privacy Policy. Provisions that by their nature should survive termination remain in effect.
17. Dispute resolution
17.1 Informal resolution
Please contact us first at [email protected] so that we can try to resolve the matter directly. We aim to answer within 30 days. You are free to go to court, or to a consumer body, at any time without contacting us first.
17.2 Governing law
These Terms are governed by the laws of Poland, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17.3 Jurisdiction
If you are a consumer in the European Union. Under Articles 17 to 19 of Regulation (EU) 1215/2012 you may bring proceedings against us either in the courts of Poland or in the courts of the country where you live, whichever you prefer. We may bring proceedings against you only in the courts of the country where you live. The choice of Polish law above does not deprive you of the protection of the mandatory consumer rules of your own country.
If you are a consumer outside the European Union. The mandatory consumer protection rules of the country where you live continue to apply to you.
If you use the Service for business purposes. Disputes will be heard by the courts of Warsaw, Poland.
17.4 Out of court dispute resolution
The European Commission's Online Dispute Resolution platform was discontinued on 20 July 2025 by Regulation (EU) 2024/3228 and no longer exists. Any link to it that you find elsewhere is out of date.
If you are a consumer in the European Union, you can still use an alternative dispute resolution body under Directive 2013/11/EU. In Poland this includes the permanent consumer arbitration courts and the mediation service run by the Trade Inspection, and consumers can get free help from a municipal or district consumer ombudsman. For a cross border dispute, the European Consumer Centres Network can help you free of charge.
We are not obliged to use, and have not committed to using, any particular arbitration body. We will nonetheless consider in good faith any proposal to resolve a dispute through such a body.
17.5 Collective redress
We do not ask you to give up any right to take part in collective proceedings. If you are a consumer in the European Union, Directive (EU) 2020/1828 allows qualified entities to bring representative actions on behalf of consumers, and nothing here affects that.
18. Changes to terms
We may modify these Terms at any time. When we make material changes, we will:
- Post the revised Terms with an updated "Last Updated" date
- Notify you via email or in-app notification (for significant changes)
- Give you at least 30 days' notice before the change takes effect
We change these Terms only for a reason: to reflect a change in the law or a regulator's requirement, to describe a new or changed feature, to improve clarity, or to address a security or abuse problem. We will say which reason applies.
If you do not accept a change, you can close your account during the notice period at no cost, and the change never applies to you. You can spend your EcoDrops first. Continuing to use the Service after the change takes effect means you accept it. We will not treat silence as acceptance of a change that reduces your rights without first telling you directly by email or in the app.
19. General provisions
19.1 Entire agreement
These Terms, together with our Privacy Policy, Cookie Policy, Acceptable Use Policy and EcoDrops Rewards Terms, are the whole agreement between you and BrainGreen Foundation about your use of the Service.
If you also act as a partner or a public body, these are the rules on which document wins, and they are the only such rules:
- For anything you do in that role, the terms for that role prevail: the Refill Partner Terms, the Reward Partner Terms or the Municipality Terms. That includes the liability provisions in them.
- For anything you do as an ordinary user, such as finding a point or recording your own refill, these Terms prevail.
- The Privacy Policy prevails over all of them on how we handle personal data.
- Where a document is silent, the others fill the gap. Nothing here removes a right you have under law that cannot be excluded by agreement.
19.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19.3 Waiver
Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
19.4 Assignment
You may not transfer your rights under these Terms. We may transfer ours to a successor that takes over the Service, provided this does not reduce your rights. If a transfer would reduce them, we will tell you first and you may close your account.
19.5 Force majeure
We are not liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, or government actions.
19.6 No third-party beneficiaries
These Terms do not create any rights for third parties, except as expressly stated.
19.7 Language
We publish this document in English and in Polish. If you are a consumer habitually resident in Poland, the Polish version is the binding one. For everyone else the English version prevails if a translation differs. Both are available at any time, and a link to the other one sits at the top of this page.
